Taco Tuesday

    Its rather festive here at the Law firm today. We received a bunch of fully favorables and that gets us all in a great mood. A fully favorable is the written decision awarding benefits to a claimant. Meaning; they are going to get their money soon. Well, soon is a relative term. Most folks have waited 60 days to be denied and then waited two years to get in front of an Administrative Law Judge and then another 6 to 8 weeks until they receive their decision. Hopefully its a fully favorable decision.  Count another couple three weeks until the money flows.
   The reason for the long wait to get in front of the judge is due to the high number of people waiting in any given area. The case during that time is called, "unworked and unassigned." By golly they mean that and only under limited conditions will a case move or "leap-frog" over those already in line waiting for their hearing. We don't know who the judge is until the case is assigned one about 2  & 1/2 months out from the hearing date.  That's a thumb nail sketch of procedural law with the Social Security Administration. IMHO taking 8 weeks to get a decision is way to long. SSA came up with a short cut called a bench decision. That is a fully favorable decision by the judge at the time of trial which results in getting the written confirmation in about a week or two and money flowing in about a week or two after that.
   Sadly not many judges are using this avenue and claimants are having to delay their festive day longer than they should. IMHO. hasta mañana
